Drunk Driving Defense

drunk driving defense
was it self defense…..?

First and foremost my English is kind poor; Thanks for your understanding.

Last night Somali yellow cap/ Taxi driver picked a drunk Mexican passenger from down town Seattle to City of Seatac (About 15 minutes drive)

When they reached the destination they wanted Mexican guy refused to pay, The cap driver tried to call the police.

Before he knew it the Mexican guy stabbed twice the Somali driver and, tried to run away.

The Somali driver pulled the knife himself and ran after the drunk guy and stabbed 5 times.

Both of the men are in hospital and I heard this morning the Mexican guy is in Critical condition.

was that a self defense? what is the Somali cap driver going to face if if they come to court ?

No, this was NOT self defense. If the driver had pulled a weapon BEFORE the passenger fled, it would be self defense. As soon as the attacker ceased his attack, it was no longer self defense and became retaliation. The line is that self defense is action taken to STOP an attack. Once the attack is stopped, any further action is not self defense. In the case you describe, BOTH the driver and the passenger are guilty of assault with a deadly weapon and possibly attempted murder.
